§ 101136 Filling Board Vacancies

This law says a vacant position must be filled within 30 days, and if a certain type of vacancy isn’t filled in time, a special five‑person committee will pick someone within the next 30 days.

Key Takeaways

  • •A vacancy must be filled within 30 days of it happening.
  • •If the vacancy is the special type mentioned in Section 101103(c) and the board doesn’t act, a conference committee steps in.
  • •The committee has five members: 2 chosen by the board, 2 chosen by the city council, and 1 chosen by those four.
  • •The committee must fill the vacancy within 30 days after it takes over.

Example

A member of a local board quits, and the board doesn’t choose a replacement within 30 days.

Because the board missed the deadline, a group of five people – two board members, two city council members, and one extra person they pick – will vote to fill the spot within the next 30 days.
