§ 101104 Fifth Board Member Appointment

If the four people on a board don’t choose the fifth member within 30 days, a special five‑person committee will pick that fifth member within the next 30 days.

Key Takeaways

  • •The four board members have 30 days to appoint the fifth member.
  • •If they miss that deadline, a conference committee steps in.
  • •The committee has five people: 2 supervisors, 2 council members, and 1 person chosen by the original four.
  • •The committee must pick the fifth member within 30 days of being formed.

Example

Four members of a city board are supposed to add a fifth member but can’t agree after a month.

Because they missed the deadline, a group made up of two city supervisors, two city council members, and one person chosen by the four board members will vote and pick the fifth board member within the following 30 days.
