§ 2816 Abandoned Water Rights

Key Takeaways

  • •If you start a claim to use water but don't finish it on time, you lose your right to that water.
  • •The board gives you a deadline to finish your claim. If you miss it, you can ask for more time, but only if you ask before the deadline.
  • •If you don't finish on time and don't get extra time, it's like you never asked for the water in the first place.

Example

A farmer starts the process to use water from a river for his crops but doesn't finish the paperwork on time.

If the farmer doesn't finish his water claim by the deadline and doesn't ask for more time before the deadline, he loses his right to use that water. It's like he never asked for it.
