§ 11910 Ordinance Adoption And Publication

Key Takeaways

  • •New rules can't be made too quickly—they need at least 5 days after being introduced and must be voted on during a regular meeting.
  • •After a new rule is passed, the public must be told about it—either a short summary or a bigger ad in the paper.
  • •The full rule must be posted in the board's office with the names of who voted yes or no.
  • •If the rule is too complicated to summarize, a bigger ad must be put in the paper telling people how to get the full rule.

Example

Your town wants to pass a new rule saying dogs must be on a leash in parks.

The town board can't vote on this rule the same day it's introduced—they have to wait 5 days and vote at a regular meeting. After it passes, they must either print a short summary in the paper or put up a bigger ad telling people about the rule and where to find the full details. They also have to post the full rule in their office with the names of who voted for or against it.

(a) No ordinance shall be passed by the board within five days of the day of its introduction or at any time other than a regular or adjourned regular meeting. All ordinances or summaries of ordinances shall be published after passage. (b) The publication of ordinances, as required by subdivision (a), may be satisfied by either of the following actions: (1) Within 15 days after adoption of the ordinance or amendment to an ordinance, the board of directors shall publish a summary of the ordinance or amendment with the names of those directors voting for and against the ordinance or amendment and the secretary shall post in the office of the secretary of the board of directors a certified copy of the full text of the adopted ordinance or amendment along with the names of those directors voting for and against the ordinance or amendment. (2) If the general manager determines that it is not feasible to prepare a fair and adequate summary of the adopted ordinance or amendment, and if the board of directors so orders, within 15 days after adoption of the ordinance or amendment to an ordinance, a display advertisement of at least one-quarter of a page shall be published. The advertisement shall indicate the general nature of, and provide information about, the proposed or adopted ordinance or amendment, including information sufficient to enable the public to obtain copies of the complete text of the ordinance or amendment, and the names of those directors voting for and against the ordinance or amendment.
