§ 101135 Board Vacancy Appointments

This rule says that when a board member leaves, someone is appointed to finish the rest of that member's term, and the appointment is made by the same group that normally picks that type of director.

Key Takeaways

  • •A vacant board seat is filled only for the time left in the original term.
  • •The appointment is done by the same body that is allowed to appoint that class of director.
  • •The rule applies each time a board member’s seat becomes empty.

Example

A school board has five members and one of them resigns halfway through their two‑year term.

The group that normally chooses that kind of board member (for example, the school district's superintendent) will pick a new person to serve for the remaining year of the term.
