§ 103112 Board Vacancy Appointment Rules

If a spot on a board opens up, the same group that chose the person who left gets to pick someone new to finish the rest of the term.

Key Takeaways

  • •A board vacancy is filled by appointment, not by election.
  • •The appointing body must be the same one that originally appointed the departing member.
  • •The new appointee serves only for the remaining part of the original term.

Example

A member of a city planning board quits halfway through their two‑year term. The mayor’s office, which originally appointed that member, selects a new person to serve until the term ends.

Because the mayor’s office made the original appointment, they get to choose the replacement, and the new person only serves for the time left in the old member’s term.
