§ 101105 Director Term Succession

This law says that a new director must be chosen within 30 days before the current director's term ends, and the same group that normally picks that kind of director does the appointment.

Key Takeaways

  • •A replacement must be named within the 30 days before a director’s term finishes.
  • •The appointment is done by the same body that is normally allowed to pick that class of director.
  • •The rule prevents a director’s seat from being left empty.

Example

A city council member's term ends on July 31. The council must pick a replacement by July 1, and the council itself (the group that normally selects council members) makes the appointment.

Because the law requires a successor to be chosen within the 30‑day window before the term ends, the council has to act by July 1 to avoid the seat being empty.
