§ 55105 Local Agency Pledge Validity

Key Takeaways

  • •If a local government promises to use certain money or property for a specific purpose, that promise is final and must be kept.
  • •The money or property promised is locked in for that purpose as soon as it's received, even if no one else knows about the promise.
  • •No one else can take that money or property for any other reason, even if they have a claim against the government.

Example

A city promises to use money from parking meters to fix local schools.

As soon as the city gets the parking meter money, it must go to the schools. Even if someone sues the city for something else, they can't take that money.
