§ 52036 Bond Pledge Validity Rules

Key Takeaways

  • •If a city or county promises to use certain money or property to pay back a loan (like bonds), that promise is official right away.
  • •The money or property promised is locked in for paying back the loan, even if others think they have a right to it.
  • •No need to physically hand over the money or property or do extra paperwork for the promise to count.
  • •The promise stays strong even if someone else later says they deserve that money or property.

Example

A city promises to use money from parking meters to pay back a loan for building a new park.

Even if someone sues the city later, the parking meter money must still go to paying back the loan first. The promise is locked in as soon as it’s made.
