§ 51357 Pledge Validity And Lien

Key Takeaways

  • •If the agency promises to use certain money or property for something, that promise is official right away.
  • •The money or property promised is locked in for that purpose as soon as it’s received—no need to hand it over or do extra paperwork.
  • •No one else can take that money or property, even if they say the agency owes them something.
  • •The agency doesn’t have to file any special papers to make this promise official.

Example

The agency promises to use money from parking fees to fix potholes.

As soon as the agency says the parking fee money is for potholes, that money is locked in for potholes only. Even if someone sues the agency for something else, they can’t take that parking fee money.
