§ 33437 Redevelopment Property Use Requirements

Key Takeaways

  • •If you buy or rent property in a redevelopment area, you must use it for what the plan says (like building homes or shops, not leaving it empty).
  • •You have to start fixing up or building on the property within a set time—no waiting forever.
  • •You can’t just buy the land to sell it later for a big profit; the rules stop people from doing that.
  • •The agency can add other rules to make sure the project helps the community, not just the buyer.

Example

A company buys an empty lot in a redevelopment area to build apartments.

The company must start building within the time given (like 2 years) and can’t just sit on the land to sell it later for more money. If they break the rules, the agency can take the land back.

§ 33437 Redevelopment Property Use Requirements

An agency shall obligate lessees or purchasers of property acquired in a redevelopment project to: (a)  Use the property for the purpose designated in the redevelopment plans. (b)  Begin the redevelopment of the project area within a period of time which the agency fixes as reasonable. (c)  Comply with the covenants, conditions, or restrictions that the agency deems necessary to prevent speculation or excess profittaking in undeveloped land, including right of reverter to the agency. Covenants, conditions, and restrictions imposed by an agency may provide for the reasonable protection of lenders. (d)  Comply with other conditions which the agency deems necessary to carry out the purposes of this part. (Amended by Stats. 1997, Ch. 565, Sec. 3. Effective January 1, 1998.)
