§ 102660 Adoption Birth Record Inclusion

This law lets a birth record show the names of both adoptive parents even if one of them has died, as long as both were home when the child was first placed and a court order says so.

Key Takeaways

  • •Both adoptive parents must have been home when the child was first placed.
  • •A court order is needed to put both names on the new birth record.
  • •The death of one adoptive parent does not stop both names from being listed.

Example

A married couple adopts a baby. Both parents are in the house when the baby arrives. A few months later, one parent passes away. The court issues an order that says both parents' names should stay on the baby's new birth certificate.

Because the couple was together at the start and the court gave the order, the baby's birth record can list both the living parent and the parent who died.
