§ 7132 Rescinding Minor Emancipation

Key Takeaways

  • •If a kid under 18 was declared independent (emancipated) but now has no money or way to take care of themselves, they (or someone helping them) can ask a court to cancel that independence.
  • •The kid is considered to have no money if their only income is from government help (like welfare).
  • •The court will only cancel the independence if it’s good for the kid.

Example

A 16-year-old was declared independent by a court but lost their job and now only gets money from food stamps.

The kid (or their helper) can ask the court to cancel the independence because they have no money. The court will check if canceling it is best for the kid.
