§ 7131 Void Emancipation Petition

Key Takeaways

  • •If someone lied or hid important info to get emancipated (become legally independent as a minor), you can ask a court to cancel it.
  • •Anyone can file this request—even a regular person or a group, not just family.
  • •You must file the request in the same court that approved the emancipation.

Example

A 16-year-old tells the court they have a job and can support themselves to get emancipated, but really, they have no job and their friend is paying their bills.

Someone (like a parent or social worker) can go to the same court and say, 'They lied about having a job—cancel the emancipation!'
