§ 3590 Spousal Support Agreement Severability

Key Takeaways

  • •Support money (like alimony) in a divorce agreement is separate from property division.
  • •The court can enforce support payments even if other parts of the agreement fail.
  • •Support orders are legally binding, just like a judge’s decision.

Example

A couple divorces and agrees that one will pay the other $500 a month for support. Later, they argue over who gets the house.

The $500 support payment must still be paid, even if they can’t agree on the house. The court can force the payment.
