§ 77664 Timber Commission Termination Process

Key Takeaways

  • •If more than half of the timber producers (51%) who sell or buy more than half of the timber (51%) want to stop the commission, they can ask the secretary to end it.
  • •The request to end the commission must be in writing and given within 90 days.
  • •People can change their mind and take their name off the request before it’s given to the secretary.
  • •The request can be on multiple papers, but each person signing must include where they work so it’s easy to find.

Example

Imagine 100 timber producers in a state sell all the timber. If 51 of them (who also sell more than half of all the timber) sign a paper saying they want to stop the timber commission, the secretary has to end it.

The law says that if most of the big timber sellers agree, they can shut down the commission by asking in writing. It’s like a vote where the majority wins, but only if they also sell most of the timber.

§ 77664 Timber Commission Termination Process

(a) The secretary shall terminate the commission at the end of the then current marketing year if the secretary finds that the termination of the commission is requested in writing, within a 90-day period, by at least 51 percent of the eligible producers that sold or acquired at least 51 percent of the total volume of timber. (b) The producer originating the request shall file a written notice with the secretary in a manner that establishes the date the request is initiated. Any person may withdraw his or her name from the petition requesting the termination prior to the time the request is presented to the secretary. (c) The signatures to the petition requesting the termination need not all be appended to one sheet of paper. Each producer signing the petition shall specify his or her place of business in a manner that will enable the location to be readily ascertained. (d) The petition shall bear a copy of the notice of intention to terminate the commission. Signatures shall be secured within the time limit specified in this section. (Amended by Stats. 1995, Ch. 727, Sec. 144. Effective January 1, 1996.)
