§ 77374 Pepper Commission Termination Rules

Key Takeaways

  • •If more than half of the pepper farmers (who grow more than half of all peppers) and more than half of the pepper handlers (who handle more than half of all peppers) ask in writing, the group that manages pepper rules can be shut down.
  • •The people asking to shut it down must tell the secretary in writing and can change their mind before the request is officially given.
  • •The request doesn’t have to be on one piece of paper, but everyone signing must write where they work so it’s easy to find.
  • •The request must include a copy of the notice saying they want to shut it down, and all signatures must be collected within 90 days.

Example

Imagine 100 farmers grow peppers in California, and 55 of them (who grow 60% of all peppers) team up with 10 handlers (who handle 55% of all peppers). They all sign papers saying they want to stop the pepper rules group.

Since more than half of the farmers and handlers (who also control more than half of the peppers) asked, the secretary must shut down the group at the end of the current year.
