§ 74994 Producer Commission Termination

Key Takeaways

  • •If more than half of the farmers who grow most of a crop want to stop the group that helps sell it, they can ask the secretary to end it.
  • •The request to end the group must be in writing and given within 90 days.
  • •People can change their mind and take their name off the request before it’s given to the secretary.
  • •The request doesn’t have to be on one piece of paper, but everyone must sign with their name and where they work.

Example

Imagine a group of orange farmers in California who work together to sell their oranges. If 51% of these farmers, who also grow at least 51% of all the oranges, sign a paper saying they don’t want to be in the group anymore, they can send it to the secretary.

The secretary will then close the group at the end of the selling season if everything is done right. Farmers can also take their names off the list if they change their mind before the paper is sent.
