§ 7579 Court Ordered Property Disposal

Key Takeaways

  • •If a court tells you to do something with your property and you don't do it in time, the court can make someone else sell it or get rid of it.
  • •The court decides how and when your property will be sold or thrown away if you ignore their order.
  • •The person in charge of selling or disposing of your property could be a director, commissioner, sheriff, or marshal.

Example

You own an old car that the court says is a hazard and must be removed from your yard in 30 days. You ignore the order and don’t move the car.

The court can then tell the sheriff to sell your car or have it towed away because you didn’t follow their order.
