§ 17406 Board Of Supervisors Lien Subordination

Key Takeaways

  • •If the county has a claim on a property (like a lien), they can let a new loan or mortgage take priority over their claim.
  • •This only applies if the new loan is renewing or refinancing an older loan that was already ahead of the county's claim.
  • •The county can choose to do this, but they don’t have to.

Example

A homeowner has a mortgage from a bank and also owes money to the county for unpaid property taxes. The county has a lien on the house because of the unpaid taxes.

If the homeowner wants to refinance their mortgage with the bank, the county can decide to let the new mortgage take priority over their tax lien. This means the bank gets paid first if the house is sold, even though the county had a claim on it.
