§ 2751 Board Hearing Order Process

Key Takeaways

  • •If someone files important papers with the board, the board has to ask a court to set a date for a hearing.
  • •The papers include a special copy of a decision, evidence, and a written record of what happened before.
  • •The board can't just decide on their own—they need the court to pick the time for the hearing.

Example

Imagine your neighbor complains about your dog barking too much, and the city makes a rule about it. You don’t agree, so you take the city’s decision to a board.

The board gets your complaint and the city’s notes about the problem. They can’t just say, 'We’ll talk about it next week.' They have to go to a court and ask the court to pick a date for everyone to come and talk about it.
