§ 1212 Treated Wastewater Appropriation Restrictions

This law says that if someone treats wastewater and puts it back into a river or stream to help fish, wildlife, or fun activities like swimming, no one else can take that water for their own use.

Key Takeaways

  • •If cleaned wastewater is put into a river to help nature or fun activities, others can't take it.
  • •People who already have water rights can't use this cleaned water either.
  • •The rule is to protect the river's use for fish, wildlife, and recreation.

Example

A town cleans its dirty water and puts it into a river to help fish live better.

No one else can take that cleaned water for their farm or business because the town put it there to help the river.
