§ 1210 Treated Wastewater Ownership Rights

This law says that the owner of a wastewater treatment plant owns the treated water, not the people who used the water before it was treated.

Key Takeaways

  • •The owner of the treatment plant owns the cleaned water.
  • •This doesn’t change any rules about how the water must be treated or used.
  • •The law doesn’t take away the rights of people who are allowed to use the cleaned water.

Example

A town has a wastewater treatment plant that cleans dirty water from homes and businesses.

After the water is cleaned, the plant owner can decide what to do with it, not the people who originally used the water.

Nothing in this article shall affect the treatment plant owner’s obligations to any legal user of the discharged treated waste water. Nothing in this article is intended to interfere with the regulatory authority of the board or any California regional water quality control board under Division 7 (commencing with Section 13000).
