§ 95250 District Incorporation Validity

Key Takeaways

  • •Small mistakes in the process of creating a district won't cancel it, as long as they don't hurt anyone's rights.
  • •If someone wants to challenge the creation of the district, they have to do it within three months after the election results are filed.
  • •After three months, the district is officially valid and can't be challenged.

Example

A small town votes to create a new school district. The election had a minor issue, like a typo on the ballot, but it didn't affect the outcome or anyone's rights.

Even with the typo, the district is still valid because the mistake didn't hurt anyone. If someone wants to complain about the election, they have to do it within three months after the results are filed. After that, the district is official and can't be challenged.
