§ 70055 Incorporation Validity Challenges

Key Takeaways

  • •Small mistakes in the election process won't cancel the creation of a new district if they don't hurt anyone's rights.
  • •If someone wants to challenge the election, they must do it within 3 months after the results are filed with the Secretary of State.
  • •After 3 months, the district is officially valid and can't be challenged anymore.

Example

A small town holds an election to create a new school district. The ballots are printed with a tiny typo, but everyone can still read and understand them.

The typo won't invalidate the election because it didn't affect anyone's right to vote. If no one challenges the election within 3 months, the new school district is officially valid.
