§ 30600 District Property Acquisition Authority

Key Takeaways

  • •The district can get land or stuff (like buildings or equipment) in different ways, like buying it, getting it as a gift, or even taking it if really needed.
  • •They can only take or use property if it helps them do their job better, like building or improving transit services.
  • •The district can also sell, rent, or team up with others to use the property if they think it’s a good idea for the district.

Example

The district wants to build a new train station but needs a piece of land where a small shop currently stands.

The district can try to buy the land from the shop owner. If the owner refuses, the district might take the land anyway (with fair payment) because the train station will help many people. Later, if the district doesn’t need the land anymore, they can sell it or rent it to someone else.

That property includes, but is not limited to, property necessary for, incidental to, or convenient for joint development and property physically or functionally related to rapid transit service or facilities. The board may lease, sell, jointly develop, or otherwise dispose of any real or personal property within or without the district when, in its judgment, it is for the best interests of the district so to do.
