§ 29010 District Property Acquisition Authority

Key Takeaways

  • •The district can get land or stuff (like buildings or equipment) in different ways: buying it, getting it as a gift, renting it, or even taking it if they really need it (but they have to follow special rules).
  • •They can only take or use land or stuff if it helps them do their job better.
  • •If the district doesn’t need something anymore, they can sell it, rent it out, or get rid of it if they think it’s the best thing to do.

Example

Imagine the district needs a new building to open a school because all the other schools are too full.

The district can buy an empty lot nearby to build the school. If the owner doesn’t want to sell, the district might still get the land, but they have to prove they really need it and pay a fair price. Later, if the school closes and they don’t need the building, they can sell it to someone else.
