§ 103407 Collective Bargaining Exemption

If a school district picks one exclusive group to do collective bargaining, the district does not have to follow the rules in Chapter 10 of the Government Code.

Key Takeaways

  • •When an exclusive collective bargaining representative is selected, Chapter 10 rules are skipped.
  • •The exemption only happens if the selection follows Section 103401.
  • •The rule applies to the whole district, not just part of it.

Example

A school district holds a vote and the teachers' union is chosen as the only group that can bargain for all teachers.

Because the teachers' union is the exclusive bargaining representative, the district is not bound by the Chapter 10 rules that usually apply to bargaining.
