§ 1185 Memorial District Formation Consent

This law says a new district can be set up inside an existing memorial district, but only if you file the normal petition and also get a written approval from the board of the old district.

Key Takeaways

  • •The new district has to be inside an existing memorial district.
  • •You still need the regular petition required by Section 1173.
  • •You must also file a verified copy of a resolution from the existing district’s board that says it consents.
  • •All paperwork is filed with the county elections official.

Example

A community wants to start a new fire protection district inside the area that already has a memorial park district.

They must submit the regular petition for a new district and also send a verified copy of a resolution where the memorial park district’s board says it agrees to the new fire district. Both papers go to the county elections official.
