§ 1173 District Formation Petition

This law lets voters ask the county clerk to create a new voting district, but only if enough registered voters sign a petition – at least 8% of the people who voted for governor in the last election, and if the area mixes city and countryside each part must meet that 8% on its own.

Key Takeaways

  • •Petition must be filed with the county clerk.
  • •Signers have to be registered voters who live in the area they want to become a district.
  • •You need signatures from at least 8% of the people who voted for governor last time; if the area includes both city and non‑city land, each part must meet that 8% separately.

Example

In County X, 12,000 people voted for governor in the last election. A group of residents wants a new district that includes part of the city and a nearby rural area. They gather 960 signatures from city voters and 960 signatures from rural voters (each 8% of the 12,000 votes in their part) and file the petition with the county clerk.

Because they got the required 8% of voters from each area, the clerk can start the process to form the new district.
