§ 1178 District Formation Election Rules

This law says that after a hearing, the board must either drop the plan for a new district or set a special election so voters can decide on the district and pick its first leaders.

Key Takeaways

  • •The board must act right after the hearing.
  • •It can either abandon the district plan or call a special election.
  • •The special election lets people vote on the district and pick its first board.

Example

A community wants to start a new fire protection district. After the hearing, the board decides to hold a special election so residents can vote on creating the district and choose the first board members.

The board follows the law by either canceling the district plan or, as in this case, calling a special election for the community to vote and elect the first directors.
