§ 1182 District Formation Election Results

If most people vote 'yes' in a special election to create a new district, the county elections official must file official copies of the vote results and the petition within ten days after the board announces the win.

Key Takeaways

  • •A majority (more than half) of votes must be 'yes' for the district to be formed.
  • •The county elections official has ten days after the board’s declaration to file the paperwork.
  • •Both the certified vote results and the petition must be recorded, but the petition’s signatures don’t need certification.

Example

A small town holds a special election to form a new fire protection district. The vote count shows 60% in favor.

After the board of supervisors says the election passed, the county elections official has ten days to put a certified copy of the vote tally and a copy of the original petition into the county recorder’s office. The signatures on the petition don’t have to be officially certified.
