§ 1922 Seaworthiness Warranty Compliance

This rule says a ship has to be in good shape when the risk starts, but there are extra checks if the insurance is for a set time or if the cargo moves between ships.

Key Takeaways

  • •The ship must be seaworthy when the risk begins.
  • •If insurance covers a set period, the ship must be seaworthy at the start of every voyage in that period.
  • •If cargo is moved to another ship, each new ship must be seaworthy when its own trip starts.

Example

A shipping company buys a one‑year insurance policy for a cargo ship. The ship makes three trips during the year.

The ship must be ready and safe at the start of each of those three trips, not just at the beginning of the year, otherwise the warranty isn’t met.

§ 1922 Seaworthiness Warranty Compliance

An implied warranty of seaworthiness is complied with if the ship is seaworthy at the time of the commencement of the risk, except in the following cases: (a) When the insurance is made for a specified length of time, the implied warranty is not complied with unless the ship is seaworthy at the commencement of every voyage it undertakes during that time. (b) When the insurance is upon the cargo and, by the terms of the policy, description of the voyage, or established custom of the trade, the cargo is to be transshipped at an intermediate port, the implied warranty is not complied with unless each vessel upon which the cargo is shipped or transshipped is seaworthy at the commencement of its particular voyage. (Enacted by Stats. 1935, Ch. 145.)
