§ 8781 Cemetery Fund Misrepresentation Ban

Key Takeaways

  • •Cemetery workers or sellers can't say that money set aside for taking care of graves will last forever.
  • •They can't promise that the care fund is permanent or will never run out.
  • •This rule applies to anyone working for the cemetery or selling cemetery plots.

Example

A cemetery salesperson tells a family buying a grave plot that the money they pay for upkeep will cover maintenance forever.

This is against the law because the salesperson is promising that the care fund is permanent, which isn't allowed.
