§ 8560 Cemetery Land Use Protection

Key Takeaways

  • •Once land is used as a cemetery, no roads, pipes, or power lines can be built on it without permission.
  • •The cemetery owners or most of the plot owners (at least two-thirds) must agree before anything can be built there.
  • •This rule protects cemeteries from being disturbed by new construction.

Example

A city wants to build a new road through an old cemetery to make traffic easier.

The city can't just build the road—they need the cemetery's permission or the okay from at least two-thirds of the families who own burial plots there.
