§ 81035 State Compensation Recovery Actions

Key Takeaways

  • •If the state pays someone for a loss, they can ask for that money back from the person who caused the loss.
  • •The Attorney General is the one who goes to court to get the money back for the state.
  • •This only happens if the person who got paid by the state is supposed to get money from someone else for the same loss.

Example

Imagine someone gets hurt in a car crash, and the state pays their medical bills. But the crash was the other driver's fault, and that driver is supposed to pay for the hurt person's bills.

The state can ask the Attorney General to go to court and get the money back from the driver who caused the crash, so the state isn't paying for something that wasn't their fault.
