§ 81030 State Subrogation Rights

Key Takeaways

  • •If the state pays you for a loss, they get your right to sue the person who caused it.
  • •You can't get paid twice—once by the state and again by suing the person who hurt you.
  • •The state takes over your claim to get their money back from the person at fault.

Example

Your car gets wrecked in an accident, and the state pays you for the damage.

The state now has the right to sue the driver who caused the crash to get their money back. You can't sue that driver yourself anymore.
