§ 11561 Parolee Substance Abuse Detention

Key Takeaways

  • •If someone on parole is using drugs or alcohol too much, or is about to start, they can be sent to a special treatment place for up to 90 days.
  • •The police or parole officers can take them to this treatment place without it meaning their parole is canceled yet.
  • •No one can be forced into this treatment if they don’t want to go.

Example

A person on parole starts drinking alcohol every day and misses meetings with their parole officer.

The parole officer can send them to a treatment center for up to 90 days to help them stop drinking. The police can take them there, but it doesn’t mean their parole is automatically canceled. However, if the person refuses to go, they can’t be forced.

§ 11561 Parolee Substance Abuse Detention

When the parole authority concludes that there are reasonable grounds for believing that a person on parole is addicted or habituated to, or is in imminent danger of addiction or habituation to, controlled substances or alcohol, it may, in accordance with procedures used to revoke parole, issue an order to detain or place the person in a substance abuse treatment control unit for a period not to exceed 90 days. The order shall be a sufficient warrant for any peace officer or employee of the Department of Corrections to return the person to physical custody. Detention pursuant to the order shall not be deemed a suspension, cancellation, or revocation of parole until the parole authority so orders pursuant to Section 3060 of the Penal Code. A parolee taken into physical custody pursuant to Section 3060 of the Penal Code may be detained in a substance abuse treatment control unit established pursuant to this article. No person on parole shall be placed in a substance abuse treatment control unit against his or her will. (Amended by Stats. 2003, Ch. 468, Sec. 5. Effective January 1, 2004.)
