§ 114830 Statewide Regulatory Preemption

Key Takeaways

  • •The rules made by the state department must be the same everywhere in the state.
  • •No city, county, or other local group can make their own rules if they disagree with the state's rules.
  • •This makes sure everyone in the state follows the same rules, no matter where they live.

Example

A city wants to make a rule that says all restaurants must close by 9 PM.

If the state's rule says restaurants can stay open until 11 PM, the city cannot make its own rule to close them earlier. The city must follow the state's rule.
