§ 110790 Export Food Labeling Exemption

Key Takeaways

  • •Food made for export won't be called 'misbranded' if it meets the buyer's rules.
  • •The food must follow the laws of the country it's being sent to.
  • •The shipping box must clearly say the food is for export.
  • •If the food is sold in the U.S. instead, these rules don't protect it.

Example

A company in California makes cereal to send to Canada.

The cereal must match what the Canadian buyer asked for, follow Canada's food laws, and have a label on the box saying it's for export. If the company tries to sell the same cereal in a U.S. store, it has to follow all U.S. food labeling rules.
