§ 108215 Hazardous Substance Exemptions

This law says some dangerous things, like chemistry sets or fireworks, don't have to follow the usual rules if they have clear warnings and are meant for older kids who can read and understand them.

Key Takeaways

  • •Some dangerous toys or items can still be sold if they have good warnings.
  • •The warnings must be easy for older kids to read and understand.
  • •This only applies to things like chemistry sets or fireworks, not everything.

Example

A 12-year-old gets a chemistry set for their birthday.

The set has acids and other dangerous chemicals, but it's okay to sell because it has big, clear warnings like 'WEAR GLOVES' and 'DON'T MIX THESE' that a 12-year-old can read and follow.
