§ 108135 Hazardous Substance Definition

This law says that any product that isn’t a registered poison but still contains a poison that makes it dangerous is called a hazardous substance.

Key Takeaways

  • •A product can be hazardous if it contains a poison, even if it isn’t officially a pesticide.
  • •The law looks at whether the product bears or contains an economic poison.
  • •This definition connects to other sections that also talk about hazardous substances.

Example

A household cleaning spray that isn’t sold as a pesticide but contains a poison that can make people sick.

If someone gets hurt using the spray, the law treats the spray as a hazardous substance because it holds a poison even though it isn’t listed as a pesticide.
