§ 101245 Employee Transfer Protection

This law moves certain long‑time civil‑service workers from the Director of Benefit Payments to the department, but keeps their jobs, pay, and benefits the same.

Key Takeaways

  • •Only non‑temporary civil‑service officers and employees who were on the job on July 1 1978 are covered.
  • •They must be doing a function that the department is given by Section 101235.
  • •Their job status, position, and rights stay the same after the transfer, unless their job is exempt from civil service.

Example

Jane has been a regular civil‑service employee at the Director of Benefit Payments since before July 1 1978, doing a job that the department is supposed to handle.

When the law takes effect, Jane is automatically transferred to the department, but she keeps her same title, salary, and other job rights because the transfer doesn’t change her status.
