§ 100852 Laboratory Certification Standards

This law lets the state board give a certificate to a lab that uses EPA‑approved testing methods, lets the board accept performance‑based methods (and charge a fee for reviewing them), and says the board doesn’t have to follow certain other state rules to issue the certificate.

Key Takeaways

  • •The state board can issue certificates to labs that use EPA‑approved testing methods.
  • •When a performance‑based method is required, the board can accept it and may charge a review fee.
  • •The board does not have to follow Chapter 3.5 of the Government Code to issue these certificates.

Example

A company runs a water‑quality lab that follows the EPA’s Part 136 testing method for drinking water. The owner applies to the state board for a certificate, and the board issues it because the lab uses the approved EPA method.

Because the lab follows an EPA method listed in the law, the state board can give it a certificate, even though other state rules might normally apply.
