§ 1267 Pilotage Tariff Revision Petition

This law explains how to file a petition to change a pilotage tariff, listing what must be included and how the petition should be submitted.

Key Takeaways

  • •The petition must be signed and include the petitioner’s name and contact information.
  • •If multiple parties join, each must sign and list their own interest in the tariff.
  • •A hearing request with a proposed date must be included.
  • •The proposed tariff and its changes must be attached, showing deletions (strikethrough) and additions (underlining).
  • •Testimony must explain why the current tariff is not fair, just, reasonable, or sufficient, with supporting exhibits.
  • •Any joint stipulations or agreements from prepetition meetings must be copied.
  • •Petitions must be filed both as a paper copy and an electronic copy in the board’s required format.
  • •Electronic notice and copies must be provided to all stakeholders who requested to participate in prepetition meetings.

Example

A small shipping company wants to lower the fees it pays for harbor pilot services.

The company prepares a petition that names the petitioner, includes a request for a hearing with a proposed date, attaches the current tariff with the proposed changes marked, explains why the existing tariff is unfair, and provides any agreements made before filing. They then submit one paper copy and one electronic copy of the petition and notify all parties who were invited to prepetition meetings.
