§ 1279 Rerefer Case Review

This law explains how an administrative judge handles a case that the board sends back for more review, setting strict rules for briefing and limiting what can be considered.

Key Takeaways

  • •The board can ask the judge to redo the review of a petition.
  • •The judge must set a briefing deadline and limit topics to the issues the board raised.
  • •No new discovery or data requests are allowed during briefing.
  • •The judge can issue a revised tentative order, which parties may request to change.
  • •The board must follow certain steps but cannot take final action on the order in specific ways.

Example

A utility company asks the state board to change its rates. The board decides to send the case back to an administrative judge for another look.

The judge tells both the utility and the consumer group to file briefs within a set deadline, but they can only discuss the issues the board listed and cannot ask for new evidence. After reviewing the briefs, the judge issues a revised draft order, which the board can adopt without holding another public hearing.
