§ 1261 Petition Notice And Hearing Process

When the executive director gets a notice that someone wants to start a petition, they have to put it on the next board meeting agenda, tell the hearing office to get a judge, and let the petitioner know who wants to join the early meetings.

Key Takeaways

  • •The director must schedule the petition item for the next regular board meeting and publish the notice for the public.
  • •The director must notify the Office of Administrative Hearings so a judge can be assigned for the hearing.
  • •The director must inform the petitioner about any stakeholder who wants to join the pre‑petition meetings before the deadline.

Example

A neighborhood group sends a notice that they want to petition the city to change a parking rule.

The executive director will add this request to the agenda for the next board meeting and publish the notice so the public knows. They will also email the Office of Administrative Hearings to get a judge assigned for the later hearing, and they will tell the group which other people have asked to be part of the pre‑petition talks.
