§ 4411 Contract Termination Compensation Rules

Key Takeaways

  • •If a contract ends, it must say how and if anyone gets paid.
  • •The person who did the work gets paid for what they actually did, even if the job isn't finished.
  • •If a part of the job is fully done and has its own price in the contract, that price is used.
  • •The people in the contract can agree to use the contract price for the work done, even if it's not all finished.

Example

You hire someone to paint your house for $2,000. They paint half the house, but then you cancel the contract.

The painter should get paid for the half they painted. If painting half the house is worth $1,000, that's what they get. But if the contract says painting the front of the house costs $1,200 and they finished that, they get $1,200 for that part.

Such an agreement shall include the terms and conditions of the termination of the contract and provision for the payment of compensation or money, if any, which either party shall pay to the other or any other person, under the facts and circumstances in the case. Compensation to the contractor shall be determined on the basis of the reasonable value of the work done, including preparatory work. As an exception to the foregoing, in the case of any fully completed separate item or portion of the work for which there is a separate contract price, the contract price shall control. The parties may in any other case adopt the contract price as the reasonable value of the work done or any portion thereof. (Added by Stats. 1949, Ch. 1105.)
