§ 32035 Military Service Credit For Officers

Key Takeaways

  • •If you were a cop, joined the military during a war or emergency after June 1, 1940, and came back to being a cop within 90 days after leaving the military, the time you were in the military counts as if you were still a cop.
  • •You have to pay back into the cop fund what you would have paid if you were still a cop during your military time. You can do this while you're away or within 1 year after you come back, plus up to 2 more years if the board allows it.
  • •This rule helps cops who served in the military keep their benefits like they never left.

Example

A police officer named John leaves his job to join the Army during a war. After 2 years, he comes back and starts working as a cop again within 90 days.

John's 2 years in the Army count as if he was still a cop. But he has to pay back the money he would have put into the cop fund during those 2 years. He can pay it while he's in the Army or within 1 year after he comes back, plus maybe 2 more years if they let him.
