§ 23397 Court Jurisdiction After County Creation

Key Takeaways

  • •If a new county is created, the old county's court still handles cases that were already started there.
  • •This only applies to cases that were ongoing before the new county was formed.
  • •The court keeps control of these cases even if the area is now part of a new county.

Example

A small town is part of County A, but it becomes its own County B. Before this change, someone in the town sued their neighbor over a property line.

Even though the town is now County B, the court in County A will still decide the property line case because it started before the new county was created.
